UPDATE: Distribution of any of the Settlement’s benefits to the Settlement Class is delayed indefinitely.  On June 21, 2020, an objector, John Douglas Morgan, filed an appeal from the Settlement and fee award to the U.S. Court of Appeals for the Tenth Circuit.  The U.S. District Court for the Western District of Oklahoma had granted final approval of the Settlement on May 22, 2020 and issued its fee award to Class Counsel on June 11, 2020.  However, due to the appeal, the distribution of Settlement benefits is delayed until the appeal is resolved.  Class Counsel and Defendants are defending the Settlement on appeal.  Please continue to check this website for further updates.

YOUR LEGAL RIGHTS AND OPTIONS IN THIS SETTLEMENT:

SUBMIT A CLAIM FORM BY August 6, 2019

This is the only way to get certain benefits described above, including for those that qualify and as provided by the Settlement, an Enhanced Minimum Recall Rebate, a Recall Repair Additional Benefit, and relief for a Top-Load Washer’s Top Separation or Drain Pump Failure that has occurred in the past. The claim deadline has passed.

EXCLUDE YOURSELF BY 
June 7, 2019

This is the only option that allows you to ever be part of another lawsuit against Defendants and/or Retailer Defendants about the legal claims resolved by this Settlement. If you exclude yourself from this Settlement, you will not be entitled to any of the benefits from this Settlement. The exclusion deadline has passed.

OBJECT BY June 7, 2019

This is the only way to tell the Court that you are unhappy with something about the Settlement. The objection deadline has passed.

ATTEND A HEARING ON October 7, 2019 AT 10:00am

The Court held a Fairness Hearing on October 7, 2019 to determine whether to grant final approval of the Settlement.  On May 22, 2020, the Court granted final approval of the Settlement. On June 21, 2020, an objector filed an appeal from the Settlement to the U.S. Court of Appeals for the Tenth Circuit. Due to the appeal, the distribution of Settlement benefits is delayed until the appeal is resolved. Class Counsel and Defendants are defending the Settlement on appeal.

DO NOTHING

If you did nothing, you will not be allowed to receive certain benefits provided by the Settlement. You also will give up your right to ever sue Defendants and/or Retailer Defendants regarding the legal claims resolved by this Settlement if the Settlement is granted final approval.
